1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the website located at https://nutriva-labs.com (the "Site") and any purchase you make through the Site. By accessing the Site, submitting a contact form, or placing an order, you agree to be bound by these Terms, our Privacy Policy, our Shipping Policy and our Refund Policy. If you do not agree to these Terms, please do not use the Site.

2. Who we are

The Site is owned and operated by NUTRIVA LABS LLC, a Wyoming limited liability company. Our registered address is 30 N Gould St Ste R, Sheridan, Wyoming 82801, United States. NUTRIVA LABS LLC is a nutrition science company that develops dietary-supplement formulations. Our products are manufactured to GMP standards in the United States, and each batch is tested by independent third-party laboratories for identity, potency and contaminants. Certificates of analysis are available on request.

3. Use of the Site

You must be at least 18 years old to purchase products from the Site. By placing an order, you confirm that you are 18 or older and that the information you provide is accurate and complete.

You agree to use the Site only for lawful purposes. You may not use the Site in any way that violates applicable law, infringes the rights of others, interferes with the operation or security of the Site, introduces malicious code, or attempts to gain unauthorized access to any part of the Site or its systems. You may not copy, scrape, or reproduce Site content for commercial purposes without our written permission.

4. Informational content and no medical advice

The content on the Site, including product descriptions, ingredient information and articles, is provided for general informational purposes only. It is not medical advice and is not a substitute for advice from a qualified healthcare professional. Nothing on the Site is intended to create a healthcare provider–patient relationship. Consult a qualified healthcare professional before starting any dietary supplement.

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

5. Products and terms of sale

When products are offered for sale on the Site, the following terms apply.

  • Order acceptance. Your order is an offer to purchase. We accept your order only when we send a shipping confirmation with a tracking number. We may refuse or cancel any order at our discretion, including where a product is unavailable, where we identify a pricing or product-description error, or where we suspect fraud or a violation of these Terms. If we cancel an order after payment, we will refund the full amount to the original payment method.
  • Pricing and typographical errors. All prices are shown in US dollars. We make reasonable efforts to keep prices and product information accurate, but errors may occur. If a product is listed at an incorrect price or with incorrect information, we may cancel the affected order and notify you, whether or not the order has been confirmed.
  • Payment. Payment is processed through Shopify checkout using Shopify Payments and its supported payment methods. Checkout is served over HTTPS. We do not store full card numbers. You authorize us to charge the total shown at checkout, including shipping and applicable taxes.
  • Taxes. Applicable sales tax is calculated and displayed at checkout before payment based on the shipping address.
  • Shipping. We currently ship within the United States only. Processing times, carriers, transit estimates, tracking and our handling of lost or damaged shipments are described in our Shipping Policy, which forms part of these Terms.
  • Refunds and returns. Eligible orders may be refunded within 30 days of the delivery date under the conditions set out in our Refund Policy, which forms part of these Terms. Gift cards and downloadable products are non-refundable.

6. Intellectual property

The Site and all of its content, including text, product names, formulations, images, logos, graphics, design and software, are owned by NUTRIVA LABS LLC or its licensors and are protected by United States and international copyright, trademark and other intellectual property laws. You may view and print pages from the Site for personal, non-commercial use. Any other use, including reproduction, modification, distribution or public display, requires our prior written consent.

7. Third-party links

The Site may contain links to third-party websites, including carrier tracking pages and payment providers. These links are provided for convenience only. We do not control third-party sites and are not responsible for their content, policies or practices. Your use of any third-party site is at your own risk and subject to that site's terms.

8. Disclaimer of warranties

The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components. Products purchased through the Site are covered by our Refund Policy; to the fullest extent permitted by law, no other warranty applies.

9. Limitation of liability

To the fullest extent permitted by applicable law, NUTRIVA LABS LLC, its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits or data, arising out of or related to your use of the Site or any product purchased through it. Our total liability for any claim arising out of these Terms or your use of the Site will not exceed the amount you paid to us for the order giving rise to the claim, or one hundred US dollars (US$100) if no purchase was made. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless NUTRIVA LABS LLC and its members, managers, employees and agents from any claims, losses, liabilities and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.

11. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any consumer-protection rights you may have under the laws of your state of residence.

12. Changes to these terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Changes apply to orders placed after the effective date of the revised Terms. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.
